CUSTOMER CONSENT TO TERMS AND DATA PROCESSING BY MAL
These Terms and Conditions (“Terms”) govern your access to and use of the mobile application and website (collectively, the “Platform”) and related services (the “Services”) provided by Mal Digital Ltd, a private company limited by shares formed in the Abu Dhabi Global Market under company registration number 25182 (“Mal”).
This section requires your active confirmation. Please read carefully before checking the boxes.
Mal Digital Ltd (“Mal”) requires your consent to process your Personal Data (including Sensitive Personal Data) and to provide you with the services of the Mal’s application (the “Platform”). Your consent must be freely given, specific, informed, and unambiguous, as required under the ADGM Data Protection Regulations 2021, as amended from time to time, and UAE Federal Law.
1. General Consent for Essential Services (Required)
By consenting below, you allow Mal to collect, process, and retain your Personal Data (including identity, contact, financial, and transactional data) for the purposes of setting up your account, providing the core services you request, administering transactions, and maintaining security.
Purposes: Account registration, Know Your Customer (KYC) verification, Anti-Money Laundering (AML) checks, executing payments and transfers, providing customer support, and fulfilling contractual obligations.
Data Types: Full name, address, Emirates ID/Passport copy, bank account details, credit card numbers and details, transaction history, device ID, and contact information.
I have read and agree to the [Link to Terms & Conditions] and the [Link to Privacy Policy]. I hereby give my explicit and unambiguous consent to Mal’s processing of my personal data for the essential purposes detailed above.
2. Consent for Processing Sensitive Data (Required for KYC/AML)
Mal is required to process certain “Sensitive Personal Data” to comply with legal and regulatory obligations. Sensitive Personal Data may include biometric data (if used for login/authentication) and potentially data revealing criminal convictions (for screening/AML compliance).
Purposes: Mandatory screening against sanctions and politically exposed person (PEP) lists, biometric authentication (if enabled), and enhanced due diligence as mandated by applicable law.
Data Types: Biometric data (e.g., facial scan for verification) and any legally required compliance screening records.
I hereby give my explicit and affirmative consent to Mal’s processing of my Sensitive Personal Data for mandatory regulatory compliance and security purposes, as set out in the Privacy Policy.
3. Consent to Cross-Border Data Transfers (Required)
To provide the Platform’s services, your personal data must be securely processed and stored using cloud infrastructure and service providers, which may be located outside the ADGM and the UAE (e.g., for cloud hosting, IT support, or payment processing).
Recipients: Service providers, data processors, and affiliated entities located in jurisdictions such as the United States.
Safeguards: The Company confirms that all transfers will be protected by appropriate legal mechanisms.
I give my explicit consent to the transfer of my personal data outside the ADGM and the UAE for the purpose of receiving the services, subject to the safeguards described in the Privacy Policy.
4. Cookies
In order for the Platform to function as intended, Mal will use cookies. Cookies are small text files that are stored on your device (computer, tablet, or mobile) when you access and use the Platform. They allow the Platform to recognize your device and store some information about your preferences or past actions. You have the ability to accept or decline cookies. If you choose to reject cookies, you may not be able to fully experience the interactive features of the Platform.

5. Consent for Marketing and Promotional Communications (Optional)
This consent is optional and is not required to use the core financial services of the Platform.
Purpose: To send you direct marketing, newsletters, and promotional offers about our new products, features, or services via email, push notification, or SMS.
I consent to receiving marketing and promotional communications from Mal related to the Platform and its services.

Your Rights and Withdrawal of Consent
Right to Withdraw: You have the right to withdraw any consent provided in this section at any time, except where the processing is required by law (e.g., AML/KYC retention).
Manner of Withdrawal: Withdrawal is as simple as giving consent. You can withdraw your optional marketing consent via the Platform’s settings. To withdraw essential processing consent, you must contact us at [Dedicated Privacy Email Address].
Consequence of Withdrawal: Withdrawing consent for essential processing will mean that we can no longer provide the core financial services to you, and your account may need to be closed, subject to our statutory retention obligations.
